The trustee terminated Hattie’s lifetime occupancy.
Not immediately.
After full hearing.
Evidence:
Repeated coercion of Donna.
Forged complaint withdrawal.
Use of false beneficiary consents.
Commercial underreporting.
Kennel confinement.
Chain assault.
The agreement’s breach standard was met.
Hattie appealed.
Lost.
She could not return to Coleman House after release.
What about Michael?
He had no independent occupancy right once Hattie’s ended.
He had lived there as her adult child and later through permission.
The house became vacant.
Donna was offered residence.
She declined.
“I don’t want that many bathrooms.”
Fair.
I could have moved in as successor beneficiary with trustee approval.
I declined too.
What happened instead?
The trust leased Coleman House to a nonprofit historic-preservation organization.
Public tours.
Small events.
Limited lodging later after proper approvals.
Revenue supported maintenance.
Donna received distributions.
No one family member controlled the building.
