Chapter 23 - THE STATE CASE
The state prosecution focused on what state evidence supported.
Aggravated animal cruelty.
Child emotional abuse/endangerment-related conduct.
Coercive behavior.
Evidence tampering when Patricia attempted to dispose of remaining materials before police entry.
Gerald faced lesser but serious counts for participation, failure to protect, and related acts where applicable.
Emily did not testify live before a packed courtroom.
Her forensic interview and other evidence were handled under protective procedures according to court rulings.
I testified.
The defense asked:
“Mrs. Foster, did you previously have anger-control problems?”
“I had grief.”
“You broke a vase.”
“Yes.”
“You shouted at Patricia.”
“Yes.”
“You once told Gerald to ‘get the hell out’ of your house.”
“Yes.”
“Would you describe yourself as emotionally reactive?”
“Sometimes.”
The lawyer paused.
Then:
“Yet you did not react violently at dinner.”
“No.”
“Why?”
I looked at Patricia.
“Because my daughter was watching to see whether adults could hurt something she loved and then control what happened next.”
