Chapter 13 - DANIEL’S DEFENSE
Daniel’s defense was sophisticated.
Asthma can deteriorate unpredictably.
They sought private medical care.
They did eventually deliver Sofia to a clinic.
No intent to kill.
Trust calls were irrelevant business panic.
The death provision message was curiosity under stress.
The St. Lucia flight was irrational fear after tragedy, not proof of consciousness of guilt.
The affair was prejudicial.
The abduction was joint-custody confusion.
Each statement contained enough truth to require work.
Joint custody did permit travel within state under some circumstances.
Not disappearance.
Not international removal.
Not concealment.
Private care was not inherently wrong.
But ignoring explicit 911 instruction mattered.
Asthma can worsen quickly.
That made delay more dangerous, not less.
The defense hired experts.
One pulmonologist testified Sofia’s attack was unusually severe and survival could not be guaranteed even with earlier treatment.
True.
Another prosecution expert testified intervention at 10:42 would have significantly improved odds.
Also true.
Law often lives between probabilities.
The trust motive was especially contested.
Daniel’s lawyer:
“My client did not benefit financially from Sofia’s death.”
Technically, he did not inherit principal.
Prosecutor:
“He benefited from avoiding a governance change.”
Not money in pocket.
Control.
Loan exposure.
The jury would decide how much motive mattered.
Then Daniel offered a plea.
Manslaughter.
Custodial interference.
Forgery.
Obstruction.
Prosecutors wanted additional felony child endangerment and longer sentencing recommendation.
Negotiations failed.
He chose trial.
Maybe because accepting manslaughter meant admitting his delay killed Sofia.
Maybe because he still believed his choices were understandable.
At a pretrial hearing, I saw him for the first time in months.
He looked thinner.
He mouthed:
I’m sorry.
I looked away.
