Chapter 14 - THE FINANCIAL CASE
Federal prosecutors tried the financial conspiracy separately.
This case was less emotional.
More dangerous to Evelyn’s remaining power.
Bellweather.
The warehouse sale.
The hidden $14 million advisory payment.
Her undisclosed guarantee relief.
The false capacity plan.
The attempted protector substitution.
Company payments.
Thomas Bell.
Dr. Marsh.
Emails.
No footage of Lily crying was necessary except limited context.
The prosecutor opened:
“This case asks whether a shareholder may manufacture another person’s incapacity to win a corporate vote.”
The answer was obvious morally.
The legal proof still took six weeks.
Evelyn’s defense argued the warehouse transaction was beneficial.
Independent experts partly agreed.
The sale price was within a reasonable range.
That did not legalize hidden conflicts or manufactured consent.
The government showed she personally negotiated the Bellweather side agreement while telling the board she had no special compensation.
Thomas Bell admitted he knew his “independent protector” nomination was conflicted.
Dr. Marsh admitted his letter was designed to create urgency.
The jury convicted Evelyn of wire fraud conspiracy, fiduciary fraud, undisclosed related-party transaction offenses, and falsification-related counts.
She was acquitted of one bribery count involving a director because the payment could not be tied to a specific vote beyond reasonable doubt.
Again:
Mixed.
Accurate.
At sentencing, victims included more than us.
Ward Fresh employees had lost bonuses.
The company paid millions in legal costs.
Pension contributions were delayed.
Meridian bidders incurred losses.
Lily suffered medical harm.
I spoke for three minutes.
“You made my daughter hungry because hunger made her easier to control.”
Then I stopped.
No speech about destroying Evelyn.
The judge imposed a long custodial sentence, partly consecutive to the state term, restitution, forfeiture, and permanent bans from fiduciary and corporate control.
Evelyn would spend much of the rest of her life in custody.
She looked at Michael before deputies took her away.
He did not look back.
Then he did.
Just once.
Grief appeared on his face.
