Chapter 23 - THE HEARING

Mother’s lawyer began with my travel calendar.
It looked terrible enlarged.
Red blocks.
Away.
Away.
Away.
Storm response.
Inspection.
Overnight.
Then photographs.
Mother at school concert.
Mother at dentist.
Mother on Halloween.
Mother baking cookies.
My work had created absences.
No denying.
Then messages.
ME:
You handle her while I’m gone.
ME:
Right now I need you to be one.
Mother’s lawyer asked:
“When you wrote ‘I need you to be one,’ what did you mean?”
“A parent-like caregiver for that night.”
“So you wanted her to function as parent?”
“Temporarily.”
“Repeatedly?”
“Yes.”
There.
Then:
“Did Melisande provide significant care after your wife died?”
“Yes.”
“Did you sometimes fail to tell her when you would return?”
“Yes.”
“Did Ione sleep at her house more than eighty nights across two years?”
“Yes.”
“Did you accept a job eighty-two miles away?”
“Yes.”
“Did you initially tell Melisande before Ione?”
“Yes.”
That hurt.
Then the voicemail.
“You will never be alone with Ione again.”
My own voice filled courtroom.
Mother’s lawyer:
“Were you trying to sever their relationship?”
“At that moment, yes.”
“Why?”
“I was furious.”
“Do you still want that?”
“No.”
Good.
Then muddy handbags.
Property damage.
Diversion.
Restitution.
I admitted.
No excuses.
Then Mother testified.
She described Elin’s death.
My collapse into work.
Ione sleeping in her guest room.
The first time Ione called for Mother after a nightmare.
Mother cried.
Real.
Then:
“I believed I was protecting stability.”
Her lawyer asked:
“Did you believe Theron could manage the move?”
Mother answered:
“I believed he would continue prioritizing work.”
Reasonable fear from history.
Then forgery.
“Did you insert his signature?”
“Yes.”
The courtroom changed.
“Did he authorize?”
“No.”
“Why?”
“I thought the consent reflected what he had already allowed me to do.”
Then:
“Did you intend to deceive the court?”
Long pause.
“Yes.”
There.
No lawyer could soften.
Then:
“Did you believe the guardianship itself would benefit Ione?”
“Yes.”
Both could coexist.
That made the case harder emotionally, easier legally.
A person can believe a goal is good and still commit fraud to reach it.
The hearing continued next day.
I left exhausted.
Not triumphant.
