Chapter 12 - DIANE’S CHILD-ASSAULT TRIAL
Evan did not testify live.
I was grateful.
His forensic interview was admitted where permitted.
The video showed enough.
Diane’s defense:
She believed Evan was grabbing food after being told to wait.
Even if true, slapping him was disproportionate.
Then the video slowed.
The plate reached his side.
His hand moved.
Diane pulled it away before his fingers touched the chicken.
Then struck him.
He had not stolen.
He had not even successfully taken food.
Diane testified.
“Why did you call it stealing?”
“I was frustrated.”
“With a four-year-old?”
“With Claire.”
There.
The prosecutor paused.
“So you were angry at Claire when you struck Evan.”
Diane tried to repair.
“I was angry with the situation.”
Too late.
Emily testified next.
She admitted everything.
The group chat.
The planned withholding.
The laughter.
“Did Diane say she planned to slap Evan?”
“No.”
“Did she plan to deny him dinner until adults were finished?”
“Yes.”
“Why?”
“To make a point to Claire.”
Simple.
The jury convicted Diane of misdemeanor assault.
The child-endangerment-related count produced a narrower conviction based on using food deprivation and physical force as punishment, but the most serious version prosecutors had initially considered was rejected.
Correct.
No chronic starvation evidence.
No serious injury.
At sentencing, Diane said:
“I made a terrible mistake.”
Then ruined it.
“But Claire had been using money to control the family.”
The judge looked at her.
“Did Claire’s financial support control your hand?”
Silence.
“No.”
“Did her request for receipts force you to deny a child dinner?”
“No.”
Good.
Sentence:
Short custodial period mostly suspended.
Probation.
Child-safety counseling.
No unsupervised contact with Evan.
No contact at all initially under a protective order.
Restitution for medical and therapy costs where permitted.
Not life imprisonment.
Not ruin.
Outside court, reporters wanted:
Grandmother starves child over money.
I refused the framing.
“Evan was not chronically starved. Diane intentionally withheld a meal and assaulted him during a planned humiliation.”
