Chapter 5 - THREE HOURS AND NINETEEN MINUTES

Theodore Mercer’s trust was not a simple cash gift.
It held:
Twenty-two percent of Mercer Holdings.
Commercial property.
A logistics subsidiary.
Investment accounts.
Estimated value:
$46 million.
The first biological daughter of Luke’s branch became the primary beneficiary.
Until age eighteen, assets remained under independent trustees.
Parents could request distributions for health, education, and support.
They could not simply withdraw principal.
So Luke could not steal forty-six million dollars by swapping bassinets.
That mattered.
Why commit a felony if he could not directly take the money?
Control was more subtle.
The child’s legal parentage affected:
Who received trust notices.
Who could petition for distributions.
Who could serve as beneficiary representative.
Who could influence voting recommendations.
And most importantly:
Theodore’s trust contained a reputation clause requiring any unacknowledged beneficiary born outside marriage to have an independent guardian ad litem before Mercer family members could represent her interests.
If the first daughter appeared to be born to Luke and me within marriage, Luke could serve as family representative immediately.
If everyone knew she was born to another woman, independent oversight would activate.
Luke did not gain money outright.
He gained access and influence.
Enough to matter.
Mercer Holdings was facing a major vote.
A private-equity group wanted to acquire its logistics division.
Luke supported sale.
Independent trustees had not committed.
A newborn beneficiary’s representative could not dictate the vote but could influence proceedings and information access.
Motive.
Still not complete.
The DNA result also created a question no one could ignore.
Who was the mother of Baby Girl Patterson?
Police expedited maternity comparison using the patient’s stored admission sample.
Hospitals retain certain blood specimens temporarily for clinical reasons.
With warrant and legal authorization, the sample could be compared.
The woman who gave birth as Natalie Patterson was biologically the infant’s mother.
Her identity remained unknown.
Her fingerprint from admission forms yielded no criminal database match.
Not a criminal.
Just hidden.
Then Luke’s deleted messages produced a first name.
Marianne.
No surname.
Marianne:
I will not let her grow up thinking Claire is her mother.
Luke:
It is temporary.
Marianne:
You said paperwork only.
Luke:
The paperwork requires discharge matching.
Marianne:
Then give me June until this is done.
The sentence made me nauseous.
She had agreed to take my baby.
Temporarily?
No parent agrees to temporary newborn exchange unless something is terribly wrong.
Detective Hayes said:
“Do not assume she intended permanent harm.”
“I’m not giving her credit for kidnapping.”
“No. But if we understand what she thought the plan was, we find June faster.”
Luke’s arrest followed.
Charges initially:
Interference with custody.
Infant endangerment.
Assault on Eli.
Evidence tampering.
Conspiracy.
Additional charges pending.
He was denied unsupervised contact with either child.
I saw him at the preliminary hearing through video.
He looked exhausted.
His lawyer said:
“Mr. Mercer maintains both infants were always intended to remain safe.”
I nearly stood.
Rachel put one hand on my arm.
Safe.
June had been carried from a hospital under false identification.
That was not safe.
Eli had been slapped because he tried to stop it.
That was not safe.
The other newborn had been stripped of her own identity and placed beside a postoperative woman.
Not safe.
Then police found Marianne.
Not through Luke.
Through the car.
Hospital garage footage showed her leaving in a gray Subaru.
License plate partially visible.
Rental company.
Vehicle recovered at Bradley International Airport.
Empty infant seat.
No blood.
No abandoned baby.
Marianne had not boarded a flight under the fake name.
Airport cameras showed her entering a restroom carrying June.
Twenty minutes later she exited wearing different clothes and carrying a different diaper bag.
Then disappeared into the parking structure.
Someone picked her up.
