Chapter 16 - Maude’s Challenge

Maude filed in civil court anyway.

Petition for declaratory interpretation of the cabana transfer.

Claims:

Edmund intended a biological Rowan descendant.

The trust phrase “granddaughter Elspeth Rowan” was ambiguous because her adoption postdated initial membership history.

Incorrect.

Adoption predated transfer.

Then:

The club’s legacy license had historically followed blood descendants.

Bylaws disagreed.

Then:

Undue influence by Gareth.

Not me now.

Interesting.

She said Gareth used conflict between parents to induce Edmund.

Evidence?

Family arguments.

No coercion.

No suspicious drafting.

Edmund used independent counsel.

Maude had separate counsel when acknowledging.

Weak.

Still her legal right to try.

The court did not throw everything out instantly.

Discovery.

Depositions.

Expense.

Frustration.

Then settlement offer:

$190,000.

Closer to market.

Trustee still declined because use purpose and rising valuation.

Maude said:

“They’re keeping it to punish me.”

Nora Bell responded through counsel:

“The trust is retaining the asset because the settlor directed continued use.”

Boring facts again.

Then Maude’s deposition.

That would matter.
