Chapter 21 - MY MOTHER OFFERS A SETTLEMENT

Lucinda’s lawyers proposed civil settlement.
She would repay all disputed funds not already recovered.
Transfer the $61,400 reserve immediately.
Pay additional restitution covering the unauthorized diversions.
Resign permanently from VFC administrative control.
Accept a five-year no-contact agreement with Adeline and the boys unless they later requested modification.
In exchange:
The family civil suit would release certain additional damages claims.
Criminal prosecution remained separate.
No private dismissal power.
Good.
Then one clause:
Rocco agrees not to remove Lucinda from the Ventresca family trust.
I laughed.
Why?
I could not unilaterally do that anyway.
Her beneficial interests were governed by trust documents.
Another clause:
No public statement calling Lucinda a thief.
Elise said:
“We can agree to accurate non-disparagement.”
So:
No knowingly false statements.
No restriction on truthful testimony or required disclosures.
Good.
Then Adeline.
She did not want a large emotional-distress trial.
She wanted:
Money restored.
Documents corrected.
Paternity officially established.
No contact.
School stability.
She accepted civil settlement after independent advice.
I did too.
Not because Lucinda deserved peace.
Because the boys deserved fewer hearings.
Then the restitution money went into:
Part direct arrears to Adeline.
Part independent child account.
Part reimbursement of legal/accounting costs where allowed.
No dramatic suitcase.
