Chapter 12 - THE WEDDING TRIAL

The assault trial lasted three days.

No trust spreadsheets except minimal context.

The video showed everything.

Leo taking the cupcake.

Evelyn approaching.

Her hand rising.

Impact.

Leo falling.

My rush toward him.

David arriving afterward.

The waitress testified.

“He had asked me earlier whether kids could have cupcakes.”

“What did you say?”

“I said dessert after cake cutting.”

“Did you give him one?”

“No.”

“Did he take one himself?”

“Yes.”

“Did that justify being struck?”

The defense objected.

Sustained.

Not her role.

Leo’s hunger came from waiting.

Not theft of food in a legal sense.

The defense argued Evelyn intended a light corrective tap and Leo lost balance.

The video showed her arm.

The force.

The sound.

The jury did not need adjectives.

Leo did not testify live.

His recorded forensic interview was admitted under child-protection rules where permitted.

“Grandma hit me because I took cake.”

“Did she say anything?”

“She said permission.”

“Did you think you had permission?”

“No.”

“Why did you take it?”

“I was hungry.”

Then:

“Daddy said don’t embarrass him.”

My heart broke again.

David sat in the courtroom.

Not beside Evelyn.

He cried.

The jury convicted her of the assault count and child-endangerment-related misdemeanor.

No felony injury count.

No fracture.

No lasting physical impairment.

Sentence:

Short custodial term.

Probation.

Mandatory intervention counseling.

No contact with Leo absent future court approval.

The financial trial still ahead.

Some people online said sentence too short.

Others said prison for a grandmother’s slap was insane.

Neither group had to explain to Leo why hunger had become something dangerous.

After court he asked:

“Is Grandma gone forever?”

“No.”

“Can she come here?”

“No.”

“Good.”

Then he asked for a cupcake.

I bought one.

Maya warned me not to turn cupcakes into therapy mythology.

She was right.

Leo ate half.

Left the rest.
