Chapter 12 - THE CRIMINAL CASE
Lucienne’s criminal case was narrower than the trust case.
Good.
Trust misconduct is not automatically crime.
The prosecutor focused on:
Physical handling of Osric.
Food withholding in documented incidents.
Repeated forced confinement? No cage here. No.
Compelled service itself did not map neatly onto serious criminal statutes.
The clearest video was the party.
Lucienne yanking Osric from chair.
Shoving heavy tray into his hands.
Pushing him forward.
Did that injure him seriously?
No.
Bruise.
Red palms.
The more serious concern was the repeated conditioning of meals.
But evidence showed he still received food later.
No malnutrition.
No starvation.
The prosecutor charged misdemeanor child endangerment and assaultive conduct.
No trafficking.
No forced-labor felony invented for outrage.
I appreciated that.
My own tray assault remained in diversion.
We were both responsible for our own conduct.
At trial, Lucienne said:
“I was teaching family service.”
The prosecutor showed the schedule.
OSRIC — SERVICE.
FAVORED COUSIN — HOST.
Then:
“Why did only one child clear plates?”
Silence.
“Why did one child eat while the other served?”
“He needed discipline.”
“Why?”
“He resisted.”
“He was four.”
Lucienne looked irritated.
Exactly the problem.
Then the child specialist testified about Osric’s statements.
No live testimony from him.
No putting a preschooler on a stand for spectacle.
The favored cousin did not testify either.
She was not relevant to criminal proof beyond video.
The jury convicted Lucienne on the misdemeanor assault and child-endangerment count.
A broader coercion count failed because statutory elements were not fully met.
Correct.
Sentence:
Probation.
Short custodial term partly suspended.
Mandatory child-safety treatment.
No unsupervised contact with Osric during the order period.
No authority over minor-beneficiary programming.
The last part already came from trust court.
Separate systems.
At sentencing Lucienne said:
“I was raised to believe service builds character.”
The judge answered:
“Service chosen and shared can build character. Humiliation imposed on a child to establish rank is something else.”
That stayed with me.
Because I did want Osric to help people.
I did not want fear of Lucienne to make every chore feel abusive.
