Chapter 9 - THE RECONSTRUCTION
The pool gate was removed under court order and transported to a testing facility.
Defense experts attended.
Prosecution experts.
Insurance experts.
Trust counsel.
Everyone wanted the same hardware to tell a different story.
Physics did not care.
They reconstructed configurations.
Original intended system:
Gate released from ninety degrees.
It closed.
Magnetic latch caught.
Alarm activated if opened.
Configuration after hinge degradation but before component removal:
Gate often closed slowly.
Sometimes stopped several inches short.
Alarm still sounded.
Configuration found after Sofia’s death:
Self-closing hinge underpowered.
Magnetic childproof catch absent.
Audible alarm absent.
Indoor annunciator absent.
If opened more than approximately eighteen inches, the gate could remain partially open depending on angle and wind.
No alert.
Could a five-year-old push it?
Yes.
Could she have opened it from fully latched position?
The original magnetic latch was gone, so irrelevant.
The replacement temporary configuration had no childproof latch at all.
Only a simple mechanical catch.
That catch was found disengaged.
Was it left disengaged by staff?
Could Sofia manipulate it?
Experts disagreed.
But once open:
Nothing automatically returned the gate to safety reliably.
Margaret remembered seeing the gate closed at breakfast.
Not testing it.
A landscaper entered the pool terrace at 8:20 Tuesday to retrieve a hose.
He said he closed the gate afterward.
Did it latch?
“I heard metal.”
Not enough.
At 9:04, another security camera showed the landscaper leaving the estate.
At 10:31, Sofia drowned.
The most plausible sequence:
Gate remained not fully latched.
Sofia pushed through.
No alarm.
No adult heard.
The defense would argue Margaret’s absence was superseding negligence.
Prosecutors disagreed.
Safety barriers exist to protect against foreseeable lapses in supervision.
Law would decide.
Then the bypass magnet yielded fingerprints.
Daniel’s.
Not surprising.
He handled equipment.
Vanessa’s too.
Also not surprising.
More important:
A text chain recovered fully from Vanessa’s phone backup.
Saturday, 6:03 p.m.
VANESSA:
Gate won’t stay shut with that magnet.
DANIEL:
Only needs to look clean tonight.
VANESSA:
And after?
DANIEL:
Mercer fixes Tuesday.
VANESSA:
Sofia’s Tuesday.
DANIEL:
Mom will have her.
VANESSA:
You’re gambling.
DANIEL:
I’m managing a property.
There.
Still not central confirmation?
Close.
Enough to create the question.
Then Sunday:
VANESSA:
Did you lock gate?
DANIEL:
Nora has tape.
VANESSA:
That isn’t a lock.
No response.
Monday:
NORA:
Landscapers removed tape. Need physical lock before Sofia tomorrow.
Daniel read.
No response.
Tuesday morning:
Vanessa received twelve missed calls from me.
At 11:18, she texted Daniel:
Why is Emma calling so much?
Daniel:
Do not answer until counsel tells us what happened with Grove.
At 2:04, after hospital and police messages:
Vanessa:
This sounds serious.
Daniel:
If it’s the pool, we have a problem.
He knew what problem.
Not what outcome.
At 5:11, while Sofia still had a heartbeat:
Vanessa:
Call Margaret.
Daniel:
No. Anything we say becomes evidence.
That sentence destroyed whatever remained of my brother in my mind.
He did not yet know Sofia would die.
He knew a child had likely been hurt.
He chose legal positioning over finding out.
The trust hearing regarding Carter Heritage management was scheduled for the next morning.
So was a prosecutorial charging conference.
But before either, forensic analysts finished recovering the buried camera recorder.
One final video file survived.
Saturday, 11:43 p.m.
Daniel and Vanessa beside the pool gate after the Halston walkthrough.
Daniel held the failed inspection in his hand.
Vanessa asked:
“You’re sure nobody can prove we knew?”
Audio.
Clear.
Daniel looked toward the gate.
Then answered:
“Not once this stuff is gone.”
