Chapter 13 - THE BONUS

The transition-fee amendment was not illegal.

Daniel, under Carter Heritage authority, could recommend consultants subject to later approval.

But he had not disclosed Vanessa’s increased compensation to independent trustees.

Conflict.

Again.

$3.4 million if Halston closed by October.

$1.5 million more than previously disclosed.

Why?

Vanessa claimed expanded scope.

Halston denied requesting it.

Carter Heritage internal memo said:

Accelerated readiness and stakeholder management.

Stakeholder management apparently included keeping me from seeing a failed pool report.

Vanessa’s deleted message:

VANESSA:

If Emma sees Mercer, she calls Mom, Mom calls trustee, trustee delays vote, we miss acceleration.

Daniel:

Then we fix before she sees it.

That was motive.

Not murder.

But concealment of known hazard.

Vanessa’s plea negotiations weakened.

The prosecutor now believed a jury should decide manslaughter.

Her attorney prepared for trial.

Daniel did too.

Then Daniel contacted me through counsel.

Request:

Mediated family communication.

I refused.

Second request:

A written apology.

I told Naomi:

“I don’t want his apology before trial.”

“Why?”

“Because I don’t want to wonder whether every sentence is strategy.”

Reasonable.

The letter remained sealed with his counsel.

No forced emotional content.

My own imperfection surfaced differently.

I had posted about Carter Grove pool safety online eight months before Sofia died.

A neighborhood parent asked whether the estate pool was fenced.

I responded:

Three layers. Margaret is obsessive about it.

Defense found the post.

Used it.

“You believed the property safe.”

“Yes.”

“You allowed Sofia there.”

“Yes.”

“You saw the gate dragging Saturday.”

“Yes.”

“Yet you brought her Tuesday.”

“Yes.”

“Why?”

“Because Daniel told me maintenance knew, and every visible system had historically been reliable.”

“Could you have kept Sofia home?”

“Yes.”

That answer hurt.

No lawyer could save me from it.

But again:

Foreseeability.

Reliance.

Concealed removal.

Not all mistakes equal.

Afterward Maya asked:

“Do you think if you punish yourself enough, Sofia comes back?”

“No.”

“Then what is guilt doing?”

“Keeping me from forgetting.”

“You won’t forget.”

“I don’t trust that.”

Grief makes memory feel like a duty.

I began writing Sofia memories.

Not death.

Life.

She hated bananas.

Loved elevators.

Believed pigeons were “city chickens.”

Called St. Lucia “Santa Lucia” because of a Christmas song.

That one destroyed me.

Daniel and Vanessa had been in the Caribbean while Sofia died.

I could not let the island own her language too.

The criminal trial date set for nine months after death.

Two defendants.

Same jury? Prosecutors sought joinder for overlapping conduct.

Defense requested separate trials.

Judge granted partial severance because each planned to blame the other and certain statements could prejudice.

Daniel first.

Vanessa later.

That mattered.

No simple united-villain trial.

Before Daniel’s trial, the recovered camera footage underwent one final enhancement.

At 11:43 Saturday, after his line—

“Not once this stuff is gone.”

Vanessa answered.

Previously unintelligible.

Now clear:

“And if someone gets hurt before Tuesday?”

Daniel looked at her.

His answer was only three words.

“Then that’s on Mom.”
