Chapter 12 - JUDITH’S DEFENSE

Judith’s defense strategy was simple.

Graham was lying to reduce his sentence.

Arthur hated her.

Nora was angry and physically aggressive.

Messages were dark humor, not literal planning.

The fall was an impulsive shove after Nora insulted her.

No financial coercion because Judith never handed me documents that night.

A real defense.

Not absurd.

Then they found a text from me to a friend six months earlier:

If Judith pushes me one more inch I swear I’ll slap her.

Metaphorical.

But now literal.

Defense would use.

I had long conflict with Judith.

True.

I had told Graham:

“Your mother wants me gone.”

True.

Did that give me motive to exaggerate push?

Video showed push.

No issue.

Could give motive to exaggerate financial plan.

Digital messages corroborated.

Fine.

Then one worse item.

At dinner before the fall, I told Judith:

“I would burn Ashwick to the ground before I mortgage my house for you.”

Not literal arson.

Witnesses heard.

Why say it?

She had needled me.

Bad phrasing.

Defense loved it.

Naomi said:

“Own it.”

I would.

Anger everywhere.

No saints.

Then Judith’s lawyer sought to exclude evidence that Graham viewed my house as escape hatch.

Court allowed limited context of financial motive but excluded some inflammatory marital commentary as more prejudicial than probative.

Good.

Not every ugly text belongs before jury.

The core:

Property refusal.

Stair plan.

Cover story.

Monday papers.

Enough.

Then my diversion class ended.

Community service:

Forty hours at a building-repair nonprofit.

Fitting.

I spent Saturdays measuring door frames and painting trim.

No cameras.

No family.

One volunteer recognized me from local news.

“You’re the stair lady.”

I groaned.

“Apparently.”

“She deserved slap.”

I answered:

“That’s why I’m here.”

He laughed.

Then realized I meant it.

Good.

At program completion, my charge would be dismissed after final review.

Not erased instantly.

Consequences.

Then Judith violated protective order indirectly.

A cousin called me:

“Judith wants you to know she’ll drop everything if you tell prosecutor it was family argument.”

I documented.

Cousin admitted Judith asked.

Court tightened no-contact and warned.

No jail yet.

Judith’s lawyer was furious with her.

Control again.

Then Arthur found himself isolated from family gatherings.

He called me at Christmas.

“Do you want to have dinner?”

I said no.

Not because anger.

Because I did not want to become his reward for testifying.

He understood.

Good.

We could care about each other without creating replacement family.

Then physical therapy discharged me.

Full range of motion.

Occasional back ache.

Stairs still triggered adrenaline.

My therapist suggested gradual exposure.

I chose public library staircase first.

Three steps.

Then subway.

Then my own basement.
