Chapter 4 - THE PETITION WRITTEN BEFORE THE PARTY

My parents had hired attorney Martin Graves to prepare the guardianship petition.

Graves withdrew within hours of learning how the draft reached me.

He agreed to speak through his own counsel.

According to his records, Marlene contacted him six weeks earlier.

She claimed I planned to move Rosie to Colorado for a new job and separate her from her only stable family.

The job offer existed.

I had not accepted it.

I had told my parents I was considering the move because the company offered better hours and a school district near Hannah’s sister.

Marlene treated consideration as betrayal.

She told Graves that I suffered violent episodes after Hannah’s death.

Her examples were ordinary grief.

A broken coffee mug dropped during a panic attack.

An argument with Walter after he called Rosie spoiled.

A door I closed too hard.

None involved violence against a person.

Graves said grandparent disagreement was not enough for guardianship.

Marlene returned with allegations that Rosie feared me and preferred staying at their house.

No independent professional confirmed it.

The draft remained unfiled because Graves requested evidence.

Bethany planned to create evidence.

Daniel met me in Patricia Cole’s office with Detective Ellis present.

He surrendered his phone and cloud credentials.

“I thought Bethany wanted a video of you yelling,” he said.

“That was acceptable to you?”

“No.”

“You still held the camera.”

“Yes.”

“Why?”

“Mom said if you moved, we might never see Rosie again.”

“That does not answer why you filmed.”

Daniel stared at the floor.

“Because every time Bethany wanted something, the easiest role was helping her get it.”

The family habit spoken plainly.

Detective Ellis asked what Bethany had instructed.

“Record Aaron when he sees Rosie. Don’t stop if he becomes violent.”

“Did she tell you Rosie would be injured?”

“No. She said they were going to make her admit taking the bracelet.”

“Did you know the bracelet was missing?”

“She texted before the party saying she planned to pretend it was.”

The detective stopped writing.

“Pretend?”

Daniel unlocked his cloud account under instruction.

The message appeared.

BETHANY: I’m using the bracelet. Dad will keep Rosie in the hall. When Aaron sees her crying, keep recording.

DANIEL: Why?

BETHANY: Because Mom needs proof he’s unstable.

DANIEL: Don’t hurt the kid.

BETHANY: Relax. It’s a scare.

I looked at my brother.

“You knew Rosie would be frightened.”

“Yes.”

“And you came.”

“Yes.”

His voice broke.

“I thought I could stop it if it went too far.”

“When did it go too far?”

“When Dad carried her into the bathroom.”

“What did you do?”

“Nothing.”

There was no useful answer after that.

The recovered party video showed me carrying Rosie into the dining room. It captured Bethany laughing, my questions, my slap, Walter’s rage, and Marlene blocking the exit.

But Daniel had not filmed the bathroom.

The black device Rosie described was separate.

Police identified it from cloud connection logs.

A compact action camera registered to Bethany’s media company had uploaded nineteen minutes before the party.

The encrypted folder finally opened.

The video began with Rosie alone in the bathroom.

Bethany adjusted the camera inside a towel shelf.

Walter held the door.

Marlene stood near the sink.

Bethany removed the bracelet from her wrist and placed it inside her own purse.
