Chapter 24 - THE CIVIL CASE
The trust pursued civil recovery.
Dad fought.
He argued Grandmother’s clawback clause exceeded normal trust purpose.
The court disagreed in part and narrowed in part.
Not every disputed expense could be recovered.
Some family distributions were contractually permissible despite poor timing.
Some vendor payments reflected actual value.
Some marina conflicts violated disclosure duties.
The forged guarantee produced damages and legal fees but no actual lender loss because it never funded under final terms.
Final settlement:
Dad repaid and forfeited approximately $2.8 million in disputed benefits and indemnity claims.
Mom repaid smaller amounts tied to committee-approved distributions where conflicts existed.
Tawny’s restitution continued.
Michael Bell’s entity relinquished the marina option.
No one went to prison for corporate theft because the evidence did not support a giant criminal scheme.
Regulators imposed governance penalties and referrals where appropriate.
Dad permanently resigned from executive leadership.
He retained reduced personal voting rights outside conflict matters.
Then, in the last hearing, the judge asked something nobody expected.
“Ms. Hart, do you intend to use the trust’s current voting position to remove Kurt Hart from the board entirely?”
I could.
Enough coalition support existed.
Dad looked at me.
For months, I imagined saying yes.
Instead:
“No.”
My attorney turned.
I continued.
“I support independent chairmanship, term limits, and conflict restrictions. I do not support removal solely because he is my father or because he hurt me personally.”
Dad looked stunned.
The judge asked:
“Why?”
“Because family governance became dangerous when personal injury and corporate authority were treated as the same thing.”
I wanted him accountable.
Not erased by my anger.
The board later gave Dad a one-year nonvoting advisory role focused on historical property knowledge.
Then he left entirely.
