I underwent an independent capacity evaluation.

No court had ordered it yet.

Leah recommended acting before Daniel’s attorneys turned refusal into another symptom.

Dr. Priya Shah met with me over three sessions.

She tested memory.

Attention.

Language.

Judgment.

Financial reasoning.

Executive function.

She asked me to explain the difference between giving a house and lending someone money against it.

“A gift transfers ownership,” I said. “A loan creates an obligation.”

“What if the intended recipient has already spent money expecting the gift?”

“That may create a dispute, but it does not automatically transfer real estate.”

“What if the recipient is your son?”

“The law does not change because I love him.”

She asked whether anger affected my decision.

“Yes.”

“How?”

“It made me see the risk more clearly.”

“Could it also make you more punitive?”

“Yes.”

“What did you do to control that?”

“I retained the deed, contacted counsel, preserved evidence, and allowed independent investigators to review the documents.”

Dr. Shah found no dementia or incapacity.

She noted mild anxiety, grief, and symptoms of depression connected to family estrangement.

Those did not erase judgment.

She also asked about my history of financial support.

“How much have you given Daniel as an adult?”

I estimated.

Tuition beyond scholarships.

Car repairs.

Rent assistance.

Credit-card payments.

Wedding contributions.

The total exceeded two hundred thousand dollars before the lake house.

“Did you set written limits?”

“No.”

“Why?”

“He was my son.”

“That describes the relationship, not the reasoning.”

The distinction stung.

I had taught Daniel that love arrived after crisis.

He failed.

I paid.

He overspent.

I covered.

He promised change.

I accepted.

Each rescue prevented discomfort and delayed accountability.

Marlene did not create that pattern.
