Chapter 5 - THE PETITION FILED BEFORE THE PARTY

My parents claimed the guardian form was a mistake.

Linda said Bethany completed the paperwork and asked them to sign as property owners. Frank said he did not read it.

The document labeled them CHILD’S LEGAL GUARDIANS in bold letters above the signature line.

The explanations sounded less believable each time they changed.

Rachel searched family-court records.

Three days before the party, Linda and Frank had filed a petition seeking guaranteed grandparent visitation with Rosie.

They alleged I had become unstable and increasingly isolated after my divorce from Rosie’s mother, Claire.

Claire lived in another state and maintained regular contact with Rosie. She had not abandoned us, died, or lost parental rights. The petition omitted her active involvement and suggested I controlled all access.

My parents also cited my “history of aggressive behavior.”

The examples were ordinary arguments stretched into accusations.

One detail came from a private conversation with Bethany.

Months earlier, I had told her I was done letting Frank scream around Rosie and that I would remove him from our lives if he threw another object.

Bethany had saved the message.

The party occurred before I knew the visitation petition existed.

Rachel believed the basement incident and Frank’s chair attack could affect it severely.

Then investigators recovered a longer setup audio file from Bethany’s phone.

Linda’s voice said:

“If Daniel loses his temper in front of everyone, we’ll have witnesses.”

Bethany answered:

“He always loses it when Rosie cries.”

Frank said something too faint to understand.

The audio stopped before the challenge began.

The purpose of the party was changing.

Bethany wanted a sponsor video.

My parents wanted evidence that I was violent and unstable.

Rosie’s fear could serve both plans.

I thought about the moment I knocked Bethany’s hand away.

Had I struck harder, chased Frank, or thrown one of the broken chair pieces, the party guests would have filmed me instead of them.

The realization made me physically ill.

I had not protected Rosie through perfect self-control.

I had come close to giving them what they wanted.

Claire flew in for the emergency hearing.

She was furious that I had left Rosie with my family after Rosie asked to come home with me.

“She told you she didn’t want to stay?”

“She said Bethany’s games were loud.”

“And you left.”

“I was gone twenty-five minutes.”

“You left.”

I wanted to defend myself.

Instead, I admitted it.

“Yes.”

Claire did not try to remove Rosie from my care. She asked the court to recognize both of us as active parents and to block my family’s petition.

The judge ordered a full evaluation.

That evening, Rosie asked why I had not taken her with me.

“I thought you were safe.”

“You said Grandma loved me.”

“She does love you.”

Rosie’s face tightened.

“Then why didn’t she open it?”

I had no answer that would make love useful.

At the end of the week, police obtained the draft of my parents’ visitation petition from Bethany’s laptop.
