Chapter 11 - THE FOOT BENEATH THE TUBING
Charlotte testified first.
She admitted using my identification, opening accounts, signing the venue contract, and accepting money from Emma’s education fund.
She admitted seeing the corroded bracket.
“Did you intend Emma to fall?” the prosecutor asked.
“No.”
“Did you know Gerald said the repair would not survive inspection?”
“Yes.”
“Why say nothing?”
“I wanted my daughter’s party.”
The courtroom remained silent.
Charlotte cried without asking anyone to rescue her from the answer.
Patricia’s attorney attacked her agreement.
“You blame your mother to reduce your sentence.”
“I blame all of us for what we did.”
“You love your sister?”
“I was jealous of her.”
“Then this is revenge.”
“My messages were written before I was arrested.”
Documents made motive less important than corroboration.
Dr. Kent explained the railing.
Dr. Levin explained Emma’s brain injury and the risk created by sudden oxygen deprivation.
Nurse Rachel described restoring the mask and discovering the flattened tube.
Josh authenticated his video.
The defense slowed the footage frame by frame.
Gerald’s shoe entered the tubing’s path.
He looked down.
His heel moved.
The saturation number fell.
“You cannot know what he saw,” Gerald’s attorney said.
Josh answered:
“I can know where he looked.”
Gerald took the stand.
He admitted the repair but denied understanding its danger.
He said Patricia removed the caution tape.
He claimed his shoe landed on the oxygen tube accidentally.
“Why not move when Nurse Rachel said Emma’s oxygen was falling?” the prosecutor asked.
“I did not hear her.”
The ICU video contained his response moments before she discovered the line.
Pay what you owe.
He had heard everything else.
Patricia testified despite her lawyer’s apparent advice.
She described herself as a mother who spent decades helping me.
She called the mask removal “a gesture meant to wake everyone from hysteria.”
The prosecutor asked:
“Why say let her die?”
“I did not mean it.”
“Why reach for the mask a second time?”
“I wanted Rebecca to listen.”
“Why prepare a guardianship petition?”
“Emma needed responsible adults.”
“Why steal from her education account?”
“Family resources should support all grandchildren.”
“Why falsify Rebecca’s debts?”
“She was always careless.”
The prosecutor displayed the account records.
Patricia had created the carelessness she cited.
The defense argued Josh’s video did not conclusively prove Gerald intended to crush the tube.
During deliberations, the jury requested an enhanced version prepared by an independent forensic laboratory.
The enlarged footage showed Gerald’s foot more clearly.
Before shifting his weight, he used the toe of his shoe to pull the loose tubing beneath his heel.
The movement was small.
