The criminal investigation began with the forged trustee consent.
Bank investigators compared the PDF to my prior signatures.
Metadata traced the document to Clara’s computer.
Harold’s login uploaded it.
Vivian’s email instructed staff to “use Bennett’s clean signature from the Ellison tax filing.”
The false board minutes supported lender representations.
The company had not yet received the thirty-eight million dollars, so investigators examined attempted bank fraud and conspiracy rather than completed theft of the full amount.
Other money had moved.
The audit identified $11.6 million in improper related-party payments and false invoices over six years.
Not all of it was criminal.
Some represented legitimate services at inflated prices.
Some violated company policy but not necessarily criminal statutes.
Some involved clear fabrication.
Investigators separated categories.
Harold initially blamed accounting staff.
Vivian blamed Clara.
Clara blamed Daniel.
Daniel entered a cooperation agreement.
He admitted creating shell invoices at Harold’s instruction and using Mercer Events to return part of the money as “family consulting distributions.”
He provided messages showing Vivian coordinated the New Year’s incident with Dr. Kline’s report in mind.
Dr. Kline was not charged as part of the financial conspiracy. His evidence showed poor professional judgment, not knowledge of the forged bank documents.
He faced licensing discipline for allowing limited observations to be used beyond their scope.
Harold’s attorney argued that I had orally authorized administrative signature.
The bank recorded a call from two weeks before closing.
A banker asked:
“Has Trustee Bennett executed the consent?”
Harold answered:
“He will. Treat it as complete.”
That was not authorization.
It was assumption stated as fact.
Vivian’s messages were worse.
Vivian:
If Bennett sees purchase option, he will refuse.
Clara:
Then remove that page before his review.
Harold:
Bank needs full document.
Vivian:
Bank gets full. Bennett gets summary.
The family had created different versions for different audiences.
