The emergency family-court hearing occurred while Lily remained hospitalized.
Brian appeared by video from county custody.
Donna sat in the courtroom beside two attorneys.
I participated remotely from a hospital conference room so I would not leave Lily alone.
The petition’s original request sought emergency custody for Brian.
After his arrest, his attorneys amended it to request temporary placement with Donna.
They argued that I was too emotionally overwhelmed to care for a medically vulnerable child.
Leah played the kitchen footage.
The thermometer displaying 104.
Donna seeing it.
Donna stepping in front of the door.
The slap.
Lily crying.
The judge watched without expression.
Donna’s attorney said:
“The family believed Mrs. Mitchell was overreacting based on a longstanding pattern.”
The judge asked:
“Does the child’s diagnosis support that belief?”
“No, Your Honor.”
“What is the diagnosis?”
“Sepsis secondary to pyelonephritis.”
“Would delay have been medically advisable?”
“No.”
“Did Donna Mitchell physically block the mother from leaving?”
“There was a family disagreement in the hallway.”
The judge replayed the footage.
“I see her standing in front of the door and gripping Claire Mitchell’s arm.”
Donna’s attorney changed direction.
“She was concerned about unsafe driving.”
“Did she offer to call an ambulance?”
“No.”
“Did she offer to transport the child?”
“No.”
“Did she acknowledge the 104-degree temperature?”
Silence.
Brian’s attorney argued the slap was isolated and out of character.
The judge said:
“That issue belongs partly in criminal court. Here, I am assessing immediate child safety.”
The custody petition was denied.
A temporary order granted me sole physical care and medical decision-making.
Brian received no contact with Lily except through later review.
Donna received no unsupervised contact and was prohibited from approaching the hospital, school, or my temporary residence.
The court ordered an independent custody evaluation rather than accepting Dr. Kline’s report.
It also required preservation of all medical, financial, and video evidence.
Donna began crying after the ruling.
Not quietly.
She turned toward the gallery and said:
“She is taking my granddaughter because I tried to feed my family.”
The judge warned her.
Outside the courtroom, Donna told reporters that I had weaponized Lily’s illness to destroy Brian.
No major news outlet attended.
She spoke to a cousin’s phone.
The video circulated among relatives.
